You pay your taxes, you get the proper identification \u2014 you practice an amount of caution that would drive the average person mad. Still, with your existence in America essentially being a legal gray area, your fate is ultimately outside your control.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For immigrants working in cannabis, this delicate balancing act is an even trickier proposition. Though it\u2019s legal at the state level, the cannabis industry&#8217;s lack of federal approval means workers in the sector are treated as an after thought \u2014 if they\u2019re even acknowledged at all. This puts immigrants who already have to navigate limited workplace protections and increased restrictions in an even tougher position.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Because of this, immigrants who grow and cultivate the nation&#8217;s cannabis often face <\/span><a href=\"https:\/\/www.veriheal.com\/blog\/suffering-death-and-exploitation-cannabis-farm-workers-share-their-stories\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">deplorable working conditions<\/span><\/a><span style=\"font-weight: 400;\">. The retail side of cannabis is not much better for immigrants either. For proof, look no further than the story of Maria Reimers. Despite trying her best to stay on the straight and narrow, Reimers\u2019 work in the cannabis industry meant she was \u201cunsuitable\u201d for U.S. citizenship.<\/span><\/p>\n<h2><b>Maria\u2019s Story<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Reimers\u2019 story starts when she meets her future husband in El Salvador and decides to leave her old life behind to follow him to his home country, the United States. She married shortly after, securing a green card in the process. In 2014, Maria and her husband decided to start a cannabis business together\u2014Cannarail Station in Ephrata, Washington\u2014a decision that the two would eventually regret.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the time, though, Maria and her husband saw the store as a pathway to a better life. The bureaucracy of the whole dispensary application process assured Maria that she wasn\u2019t doing anything wrong \u2014 a feeling she still holds to this day. Recalling how she felt at the moment, <\/span><a href=\"https:\/\/www.dailymail.co.uk\/news\/article-10639817\/Salvadoran-woman-encounters-problem-obtaining-U-S-citizenship-owns-marijuana-dispensary.html#:~:text=%27We%20didn%27t%20think%20it%20would%20be%20a%20problem%20because%2C%20among%20other%20things%2C%20I%20had%20to%20submit%20fingerprints%20to%20get%20the%20license%20for%20the%20store%2C%20so%20they%20have%20my%20information%2C%27%20Reimers%20said.%20%27My%20husband%20and%20I%20have%20never%20broken%20the%20law.%27\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Maria said<\/span><\/a><span style=\"font-weight: 400;\">:\u00a0<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cWe didn&#8217;t think it would be a problem because, among other things, I had to submit fingerprints to get the license for the store, so they have my information\u2026my husband and I have never broken the law.\u201d<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Maria\u2019s trouble started 3 years later when she applied for citizenship. Despite a sparkling application, Reimers\u2019 was rejected for lack of \u201cgood moral character.\u201d Federal immigration officials said her work at Cannarail Station meant she and her husband were trafficking illicit drugs \u2014 despite recreational cannabis being completely legal in Washington.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thankfully, Maria was able to keep her green card. However, Reimers\u2019 attorney advised her against visiting family in El Salvador as she could be detained at the border. This realization broke Reimers\u2019, \u201cI was hoping I could go visit my grandmother. I thought if I become a citizen, maybe I could help my mother. But I am incapacitated,\u201d <\/span><a href=\"https:\/\/www.politico.com\/news\/magazine\/2023\/12\/23\/biden-administration-immigrants-legal-cannabis-00133085#:~:text=%E2%80%9CI%20was%20hoping,paying%20taxes%2C%20though.%E2%80%9D\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">she said.<\/span><\/a><span style=\"font-weight: 400;\"> \u201cI\u2019ve been cut off. I can\u2019t really do much\u2026I can keep paying taxes, though.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Reimers sued U.S. Citizenship and Immigration Services over Maria\u2019s denial. They lost their first appeal in 2022 and their second in July 2023. Disappointed but with no option but to move forward, the Reimers filed an appeal with the Supreme Court in October 2023. The Supreme Court has not yet agreed to hear the case.<\/span><\/p>\n<h2><b>When Will Immigrant Cannabis Workers Get Justice?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Reimers\u2019 frustration is shared by hundreds of thousands of immigrants across the country working in cannabis. Despite living in a state where cannabis is legal, immigrants working in the industry are subject to denial of citizenship, lifetime bans from permanent residency, and in the worst cases, even deportation.\u202f<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Immigrant Legal Resource Center is one organization trying to fix this injustice. The organization has <\/span><a href=\"https:\/\/www.ilrc.org\/biden-administration-must-remove-marijuana-federally-controlled-substance#:~:text=completely%20remove%20marijuana%20from%20the%20Controlled%20Substance%20Act.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">called on the Biden administration to<\/span><\/a><span style=\"font-weight: 400;\"> \u201ccompletely remove marijuana from the Controlled Substance Act.\u201d Doing so, the organization says, would remove unnecessary legal burdens put on immigrants and residents working in the multi-billion dollar cannabis industry.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Biden\u2019s October 2022 executive order pardoning individuals with convictions for simple possession of cannabis-inspired hope that a larger change was on the way. To date, however, Biden\u2019s seemingly progressive stance on cannabis has not translated to improvements for immigrants.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Critics say Biden is dragging his feet on an issue that could easily be resolved. Kathy Brady, director of the Immigrant Legal Resource Center, says the government&#8217;s citizenship and permanent residency policies regarding individuals working in cannabis are a simple interpretation of the law. As such, \u201cWhat the administration could do would be to change their interpretation, at least for the people working in the legal industry,\u201d <\/span><a href=\"https:\/\/www.politico.com\/news\/magazine\/2023\/12\/23\/biden-administration-immigrants-legal-cannabis-00133085#:~:text=Denying%20citizenship%20or,screwed%20by%20this.%E2%80%9D\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Brady noted<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While the government and Biden continue to put off these simple changes, immigrants like Reimers continue to suffer. \u201cI\u2019ve been in this country 20 years. I am contributing to the country, but I don\u2019t have the moral character to become a citizen. Do you think it is fair?\u201d <\/span><a href=\"https:\/\/www.politico.com\/news\/magazine\/2023\/12\/23\/biden-administration-immigrants-legal-cannabis-00133085#:~:text=%E2%80%9CWe%20didn%E2%80%99t%20think%20about%20the%20consequences%20of%20getting%20involved%2C%20or%20how%20the%20federal%20law%20was%20going%20to%20affect%20us%2C%E2%80%9D%20Reimers%20said.%20%E2%80%9CI%E2%80%99ve%20been%20in%20this%20country%2020%20years.%20I%20am%20contributing%20to%20the%20country%2C%20but%20I%20don%E2%80%99t%20have%20the%20moral%20character%20to%20become%20a%20citizen%3F%20Do%20you%20think%20it%20is%20fair%3F%E2%80%9D\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Maria lamented<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While they await a decision on their case, the Reimers have been trying to sell their business to no avail.
