The figure placed it at the top of <\/span><a href=\"https:\/\/cfah.org\/cannabis-price-index\/\"><span style=\"font-weight: 400;\">The Center for Advancing Health\u2019s cannabis consumption rankings<\/span><\/a><span style=\"font-weight: 400;\"> above cities like Chicago, Denver, Toronto, and Rome.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While the victory may look impressive on the surface, a look at consumption per million residents shows that NYC is wildly underperforming. With 8.4 million total residents, NYC consumes about 7.4 metric tons of cannabis per million residents. Compare that with other recreationally legal cities like Los Angeles\u2019 (9.2 metric tons of cannabis per million residents) and Denver (9.5 metric tons of cannabis consumed per million residents) and it\u2019s clear that NYC should be doing much better.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So then, what\u2019s keeping NY and NYC from reaching their full potential? We dive into the issues plaguing the state, what lawmakers are doing to fix them, and answer whether 2024 is the year that NY\u2019s recreational market takes off.\u00a0<\/span><\/p>\n<h2><b>Why NY Can\u2019t Seem To Open Enough Dispensaries<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">New York legalized cannabis on March 31, 2021, with the passing of the Marihuana Regulation and Taxation Act (MRTA). Taking inspiration from recreational cannabis programs in states like <\/span><a href=\"https:\/\/sbg.colorado.gov\/social-equity\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Colorado<\/span><\/a><span style=\"font-weight: 400;\">, the MRTA established the Social and Economic Equity (SEE) program. New York lawmakers hoped the SEE program would ensure the state\u2019s new market prioritized uplifting individuals from a diverse set of communities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As part of these diversity efforts, state lawmakers mandated that 50% of all adult-use licenses go to SEE groups <\/span><a href=\"https:\/\/cannabis.ny.gov\/social-and-economic-equity\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">including<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Individuals from communities disproportionately impacted by the war on drugs.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Women-owned businesses<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Minority-owned businesses<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Service-disabled veterans<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Distressed farmers.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Despite its honorable intentions, the SEE program has consistently struggled to obtain funding for its applicants. <\/span><a href=\"https:\/\/www.marketwatch.com\/story\/new-york-state-to-create-200-million-fund-to-support-social-equity-cannabis-licensees-2022-01-06\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">In January 2022<\/span><\/a><span style=\"font-weight: 400;\">, New York State Governor Kathy Hochul announced her plans to create a $200 million public-private fund for social equity applicants. <\/span><a href=\"https:\/\/www.veriheal.com\/blog\/new-york-cannabis-landscape-what-every-consumer-needs-to-know\/#:~:text=%24150%20million%20to%20fund%20more%20dispensaries%20across%20the%20state\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">In late 2023<\/span><\/a><span style=\"font-weight: 400;\">, the state once again sought $150 million in funding for the program.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With funding issues impacting New York\u2019s already slow recreational license application process \u2014 the state and NYC have struggled to open enough shops to meet consumer demand. The entire state of NY currently has a meager <\/span><a href=\"https:\/\/cannabis.ny.gov\/dispensary-location-verification\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">53 dispensaries in operation<\/span><\/a><span style=\"font-weight: 400;\">. Of those 53 dispensaries, only 20 are in NYC \u2014 this includes dispensaries in boroughs like Brooklyn, the Bronx, Staten Island, and Queens. To put that number into perspective, consider that the city of Los Angeles alone has <\/span><a href=\"https:\/\/cannabis.lacity.gov\/personal-activity\/find-licensed-retailers#WeedWise\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">238 dispensaries<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><b>Will NY\u2019s Recreational Market Bounce Back in 2024?\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Without enough legal dispensaries to meet consumer demand, illicit storefronts have popped up all over New York. In New York City alone law enforcement says about <\/span><a href=\"https:\/\/www.ibo.nyc.ny.us\/iboreports\/how-high-and-how-soon-projecting-the-growth-of-the-legal-cannabis-market-in-new-york-city-august-2023.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">1,500 unlicensed dispensaries<\/span><\/a><span style=\"font-weight: 400;\"> are in operation. In the midst of an illicit market crisis, city and state-level lawmakers are stepping up to the plate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">NYC Mayor Eric Adams responded by launching the <\/span><a href=\"https:\/\/www.nyc.gov\/office-of-the-mayor\/news\/918-22\/mayor-adams-takes-action-promote-equitable-legal-cannabis-market-seizure-4#\/0\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Interagency Task Force pilot program<\/span><\/a><span style=\"font-weight: 400;\"> in December of 2022. The task force is comprised of the NYC Sheriff\u2019s Office, the NYC Police Department (NYPD), the NYC Department of Consumer and Worker Protection (DCWP), and the NY State Office of Cannabis Management (OCM). Since its conception, mayoral spokesperson Brad Weekes says the task force has <\/span><a href=\"https:\/\/www.thecity.nyc\/2023\/11\/27\/adams-unlicensed-marijuana-enforcement-landlords-sheriff\/#:~:text=%E2%80%9CSince%20forming%2C%20the%20task%20force%20has%20imposed%20more%20than%20%2463%20million%20in%20penalties%20%E2%80%94%20including%20an%20estimated%20%2440.5%20million%20in%20illegal%20product%20seized%20and%20over%20%2423%20million%20in%20civil%20penalties%20issued%20%E2%80%94%20and%20conducted%20more%20than%201%2C300%20compliance%20and%20intelligence%20inspections%2C%E2%80%9D\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">seized an estimated $40.5 million in illegal products and issued over $23 million in civil penalties<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On the state level, NY Assemblymember Jenifer Rajkumar (D) introduced the Stop Marijuana Over-proliferation and Keep Empty Operators of Unlicensed Transactions <\/span><a href=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=A08428&amp;term=2023&amp;Summary=Y&amp;Actions=Y&amp;Memo=Y&amp;Text=Y#:~:text=A08428%20Summary:&amp;text=Permits%20municipalities%20to%20enforce%20licensure,unlawful%20sales,%20including%20real%20estate.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">(SMOKEOUT) Act<\/span><\/a><span style=\"font-weight: 400;\"> on December 29th of last year. The bill seeks to allow NY municipalities to shut down unlicensed cannabis shops and seize their products. Further, the act also seeks to make the unlicensed selling of cannabis a Class-A misdemeanor.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite these efforts, experts remain hesitant about what 2024 will look like for NY\u2019s recreational market. Leading cannabis market forecasting company <\/span><a href=\"https:\/\/www.forbes.com\/sites\/irisdorbian\/2023\/12\/29\/2024-prediction-for-ny-legal-weed-market-illicit-shops-pose-a-problem\/?sh=6880cb275138#:~:text=%E2%80%9CState%20regulators%20made%20significant%20moves%20to%20address%20problems%20in%20the%20New%20York%20cannabis%20industry%20in%202023%2C%20but%20a%20limited%20retail%20landscape%20and%20stiff%20illicit%20competition%20have%20limited%20the%20market.%22\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">BDSA told Forbes that<\/span><\/a><span style=\"font-weight: 400;\">: <\/span><span style=\"font-weight: 400;\">\u201cState regulators made significant moves to address problems in the New York cannabis industry in 2023, but a limited retail landscape and stiff <a href=\"https:\/\/www.veriheal.com\/blog\/study-shows-that-cannabis-legalization-drives-up-price-of-illicit-drugs\/\">illicit competition<\/a> have limited the market.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As such, BDSA predicts that NY\u2019s legal adult-use market will only make $1.3 billion in 2024. While that may seem like an impressive figure, <\/span><a href=\"https:\/\/www.forbes.com\/sites\/irisdorbian\/2023\/12\/29\/2024-prediction-for-ny-legal-weed-market-illicit-shops-pose-a-problem\/?sh=6880cb275138#:~:text=%E2%80%9Cwith%20a%2021%2B%20population%20of%20over%2015%20million%20and%20a%20past%20six%2Dmonth%20consumer%20participation%20rate%20of%2046%25%2C%E2%80%9D\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">BDSA notes that<\/span><\/a><span style=\"font-weight: 400;\">\u00a0\u201cwith a 21+ population of over 15 million and a past six-month consumer participation rate of 46%,\u201d the state is not living up to its full potential.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>New York City (NYC) consumed an estimated 62.3 metric tons of cannabis in 2023.
