Today, <\/span><a href=\"https:\/\/www.ncsl.org\/health\/state-medical-cannabis-laws#:~:text=As%20of%20Apr.,medical%20use%20of%20cannabis%20products.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">38 US states<\/span><\/a><span style=\"font-weight: 400;\"> regulate and allow for the consumption of medical cannabis products, with tens of millions of Americans using cannabis therapeutically and around <\/span><a href=\"https:\/\/www.pewresearch.org\/short-reads\/2022\/11\/22\/americans-overwhelmingly-say-marijuana-should-be-legal-for-medical-or-recreational-use\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">90 percent of voters<\/span><\/a><span style=\"font-weight: 400;\"> endorsing medical cannabis legalization. With nearly three decades having passed since California\u2019s landmark movement to legalize medical cannabis, where is the industry now? This article explores the exciting legal and commercial movements that have taken place since medical cannabis first became a market in 1996 to move the legal medical cannabis community to where it is today.<\/span><\/p>\n<h2><b>1996: California Legalizes Medical Cannabis<\/b><\/h2>\n<p><img decoding=\"async\" class=\"aligncenter wp-image-34118\" src=\"https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/medical-cannabis-in-california.jpeg\" alt=\"medical cannabis in california\" width=\"799\" height=\"600\" srcset=\"https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/medical-cannabis-in-california.jpeg 1024w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/medical-cannabis-in-california-300x225.jpeg 300w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/medical-cannabis-in-california-768x576.jpeg 768w\" sizes=\"(max-width: 799px) 100vw, 799px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">California\u2019s Proposition 215, also known as the Compassionate Use Act of 1996, allowed <a href=\"https:\/\/www.veriheal.com\/california\/\" target=\"_blank\" rel=\"noopener\">patients with certain qualifying conditions<\/a> to cultivate and possess cannabis for medical purposes as prescribed by a medical professional. Soon thereafter, California was followed by <\/span><span style=\"font-weight: 400;\">a number of other states<\/span><span style=\"font-weight: 400;\">, such as <a href=\"https:\/\/www.veriheal.com\/alaska\/\">Alaska<\/a>, <a href=\"https:\/\/www.veriheal.com\/oregon\/\">Oregon<\/a>, <a href=\"https:\/\/www.veriheal.com\/washington\/\">Washington<\/a>, <a href=\"https:\/\/www.veriheal.com\/maine\/\" target=\"_blank\" rel=\"noopener\">Maine<\/a>, and <a href=\"https:\/\/www.veriheal.com\/hawaii\/\">Hawaii<\/a>, whose voters chose to enact similar policies between 1998 and 2000.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, medical cannabis use was <\/span><a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC6590107\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">still limited<\/span><\/a><span style=\"font-weight: 400;\"> in the first few years after legalization. First, intimidation efforts from law enforcement made many physicians unwilling to recommend therapeutic cannabis to their patients.<\/span> <span style=\"font-weight: 400;\">Soon after Prop 215\u2019s passage, the Drug Enforcement Administration (DEA) threatened to revoke the DEA license (the official registration giving medical practitioners legal authority to prescribe controlled substances in the US) of any physician prescribing cannabis. Although physicians were able to secure a victorious injunction against these threats in federal court, citing that DEA action would violate physicians\u2019 1st Amendment protections, many physicians fear writing prescriptions for medical cannabis to this day.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The other obstacle for caregivers and patients in securing medical cannabis was the substance\u2019s availability. Many medical professionals and individual users in the 90s lacked the skills or resources to cultivate cannabis plants, and the dispensary system wasn\u2019t established like it is today. This meant that it was overall more difficult for patients with legitimate prescriptions to obtain medical-grade cannabis.<\/span><\/p>\n<h2><b>2009-2018: Obama Administration Deprioritizes Federal Enforcement in Legal States<\/b><\/h2>\n<p><img decoding=\"async\" class=\"aligncenter wp-image-34119\" src=\"https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/barack-obama.jpeg\" alt=\"barack obama\" width=\"806\" height=\"536\" srcset=\"https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/barack-obama.jpeg 1023w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/barack-obama-300x200.jpeg 300w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/barack-obama-768x511.jpeg 768w\" sizes=\"(max-width: 806px) 100vw, 806px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">Former President Barack Obama, during his 2008 presidential campaign, stated his intention to reduce the aggressive anti-cannabis legal action promoted during the Bush era. In 2009, upon Obama\u2019s taking office, Deputy Attorney General James Ogden released <\/span><a href=\"https:\/\/www.justice.gov\/archives\/opa\/blog\/memorandum-selected-united-state-attorneys-investigations-and-prosecutions-states\"><span style=\"font-weight: 400;\">the Ogden Memo<\/span><\/a><span style=\"font-weight: 400;\">, which declared that the Department of Justice and the DEA would deprioritize enforcement of the federal ban on cannabis in states that legalized the plant\u2019s medical therapeutic use. The memo and other similar memos produced in 2011 and 2013 instruct federal prosecutors to pursue national cannabis policy enforcement in only certain cases (often those involving violence or other illegal activity), rather than targeting individual patients.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Unfortunately, in 2018, US Attorney General <\/span><a href=\"https:\/\/www.npr.org\/2018\/01\/04\/575679429\/attorney-general-rescinds-obama-era-marijuana-guidelines\"><span style=\"font-weight: 400;\">Jeff Sessions decided to rescind<\/span><\/a> <span style=\"font-weight: 400;\">these Obama administration guidelines. Sessions instead stated that decisions about how aggressively to pursue cannabis-related violations of federal law would be up to individual US attorneys within their jurisdictions. Essentially, this movement gave federal prosecutors around the country the volition to enforce federal law in cases involving cannabis, even in the states where the plant and its derivatives are legal.<\/span><\/p>\n<h2><b>2018: Hemp-derived CBD is Federally Legal<\/b><\/h2>\n<p><img decoding=\"async\" class=\"aligncenter wp-image-34122\" src=\"https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/young-innovative-farmer-taking-care-checking-qual-2023-11-27-04-46-00-utc-min-1024x683.jpg\" alt=\"farm bill 2018\" width=\"798\" height=\"532\" srcset=\"https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/young-innovative-farmer-taking-care-checking-qual-2023-11-27-04-46-00-utc-min-1024x683.jpg 1024w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/young-innovative-farmer-taking-care-checking-qual-2023-11-27-04-46-00-utc-min-300x200.jpg 300w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/young-innovative-farmer-taking-care-checking-qual-2023-11-27-04-46-00-utc-min-768x512.jpg 768w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/young-innovative-farmer-taking-care-checking-qual-2023-11-27-04-46-00-utc-min-1536x1024.jpg 1536w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/young-innovative-farmer-taking-care-checking-qual-2023-11-27-04-46-00-utc-min-2048x1365.jpg 2048w\" sizes=\"(max-width: 798px) 100vw, 798px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.fda.gov\/news-events\/congressional-testimony\/hemp-production-and-2018-farm-bill-07252019\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">2018 U.S. Farm Bill<\/span><\/a><span style=\"font-weight: 400;\"> made a major step forward for patients receiving cannabidiol (CBD) treatment by removing industrial hemp from the list of controlled substances scheduled under the Controlled Substances Act (CSA), essentially legalizing the plant\u2019s cultivation and trade in the country.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This legislation distinguished hemp as a variant of the <\/span><i><span style=\"font-weight: 400;\">cannabis sativa <\/span><\/i><span style=\"font-weight: 400;\">plant producing low concentrations of the psychoactive compound in cannabis, tetrahydrocannabinol (THC). The 2018 Farm Bill defines hemp as a cannabis plant with THC concentrations of no more than 0.3% contained in any of the plant\u2019s parts or derivatives. Before the Farm Bill, all cannabis plants and their products were defined as \u201cmarijuana\u201d under the CSA, effectively banning all uses of the plant. The new definition of \u201chemp\u201d removed these low-THC variants of the cannabis plant from the list of controlled substances under federal law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Consequently, farmers gained the legal framework to cultivate hemp, a primary source of CBD. That same year, the first pharmaceutical-grade hemp-derived CBD medication treating certain seizure disorders, <\/span><a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC6938286\/#:~:text=On%20June%2025%2C%202018%2C%20the,and%20Drug%20Administration%20(FDA).\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Epidiolex<\/span><\/a><span style=\"font-weight: 400;\">, was approved for therapeutic use in the United States.\u00a0<\/span><\/p>\n<h2><b>2022: The Medical Marijuana and Cannabidiol Research Expansion Act<\/b><\/h2>\n<p><img decoding=\"async\" class=\"aligncenter wp-image-34120\" src=\"https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/joe-biden.jpeg\" alt=\"joe biden\" width=\"798\" height=\"532\" srcset=\"https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/joe-biden.jpeg 800w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/joe-biden-300x200.jpeg 300w, https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2024\/03\/joe-biden-768x512.jpeg 768w\" sizes=\"(max-width: 798px) 100vw, 798px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">In December of 2022, President Joe Biden signed a new law known as <\/span><a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC9903742\/\"><span style=\"font-weight: 400;\">The Medical Marijuana and Cannabidiol Research Expansion Act<\/span><\/a><span style=\"font-weight: 400;\"> (MMCREA)<\/span><span style=\"font-weight: 400;\">, which aims to facilitate efficiency in research concerning the benefits of cannabis. The regulatory shifts entailed by the act relax various federal restrictions on cannabis availability for research purposes, with the primary focus being the increased cultivation and availability of research-grade medical cannabis.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the <a href=\"https:\/\/www.veriheal.com\/blog\/the-medical-marijuana-and-cannabidiol-research-expansion-act-has-passed\/\">MMCREA<\/a>, the government is required to maintain an \u201cadequate and uninterrupted supply of marijuana\u201d for research uses. The MMCREA promotes <\/span><a href=\"https:\/\/psychnews.psychiatryonline.org\/doi\/full\/10.1176\/appi.pn.2023.04.4.20\"><span style=\"font-weight: 400;\">expedited DEA licensing approval processes<\/span><\/a><span style=\"font-weight: 400;\"> for researchers looking to obtain cannabis for clinical study as well as for companies looking to supply cannabis products for the purposes of medical research.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Overall, the aim is that, over time, these provisions will facilitate more research into potential healthcare uses, risks, and benefits associated with cannabis use.
