This long-anticipated development marks a major shift in Kentucky\u2019s stance on cannabis, opening new doors for patients seeking alternative treatments.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With dispensary licenses granted and doctors now authorized to issue medical marijuana certifications, Kentucky\u2019s medical cannabis program is officially underway. However, while the framework is in place, patients aren&#8217;t able to purchase medical marijuana &#8212; yet.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Here\u2019s everything you need to know about the timeline, the regulations, when you can purchase cannabis products, and what to expect from Kentucky\u2019s new medical cannabis program.<\/span><\/p>\n<h2><b>Kentucky: The 38th State to Legalize Medical Marijuana<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Before the legalization of medical marijuana in Kentucky, there were some pretty strict rules surrounding the possession or cultivation of marijuana, including:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If caught with less than 8 ounces of marijuana, residents faced a misdemeanor charge that could include 45 days in jail and a maximum fine of $250<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the person was caught trafficking and distributing less than 8 ounces of marijuana, they could be charged with a <\/span><span style=\"font-weight: 400;\">misdemeanor that carries one year of incarceration and a max fine of $500<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For growing marijuana, the cultivation of five cannabis plants or less can be charged with a misdemeanor that carries one year of incarceration and a maximum fine of $500<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Harsher charges could be issued for more than the above-listed amounts of marijuana possession and cultivation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2023, Governor <a href=\"https:\/\/www.veriheal.com\/blog\/kentucky-finally-said-yes-to-medical-cannabis\/\" target=\"_blank\" rel=\"noopener\">Andy Beshear signed the measure<\/a> that officially made Kentucky the 38th state to allow medical marijuana to be sold to qualified and registered patients.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After the announcement of the upcoming legalization of medical marijuana in Kentucky, the governor signed a bill in March of 2023 that legally protected patients who possess medical marijuana that they purchase from out-of-state licensed retailers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In early 2024, a bill was signed by Kentucky\u2019s Governor to expedite the cannabis licensing process ahead by six months so the new medical cannabis market launch could also happen sooner.\u00a0<\/span><\/p>\n<h2>Kentucky Issues Initial Licenses To Cannabis Businesses<\/h2>\n<p><span style=\"font-weight: 400;\">When applications opened, five thousand applicants (4,000 of which were dispensaries) totaling $28 million in non-refundable fees submitted forms for medical marijuana business licenses. These applications flooded in during the two-month window for applying that ended in October of 2024.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, only about fifty of those dispensary licenses were selected statewide.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kentucky was also only issuing a limited number of licenses to other cannabis businesses, too.\u00a0<\/span><span style=\"font-weight: 400;\">The number and types of medical marijuana business licenses that were distributed in Kentucky were:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tier I Cultivators: 10<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tier II Cultivators: 4<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tier III Cultivators: 2<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Processors: 10<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dispensaries: 48<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Safety compliance facilities: No initial limit<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The businesses were chosen by the <\/span><a href=\"https:\/\/kymedcan.ky.gov\/Pages\/index.aspx\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Office of Medical Cannabis<\/span><\/a><span style=\"font-weight: 400;\"> using a lottery system. Three of these lotteries were hosted based on the type of business to decide who would receive licensing for the medical cannabis program launch.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In December of 2024, doctors were authorized to issue certifications to patients for medical marijuana in Kentucky. Inspectors also started the process of <\/span><span style=\"font-weight: 400;\">reviewing cannabis facilities for businesses that had been awarded a license in December 2024 as well.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kentucky&#8217;s medical cannabis law, called SB 47, was put into place and was created to be a well-regulated medical cannabis program. Then, they can apply for a <a href=\"https:\/\/www.veriheal.com\/kentucky\/\" target=\"_blank\" rel=\"noopener\">medical marijuana card in Kentucky<\/a>. <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Applicants must also submit a one-time fee of $25 to register with the state and obtain a card. The review process can then take up to a few days. Unfortunately, Kentucky is one of those few states that explicitly prohibit it. According to the verbiage in the SB 47 law, it \u201cprohibits Kentuckians from consuming raw plant material by smoking.
