Medical marijuana patients should be aware of their state&#8217;s policies on seeing and smelling cannabis before purchasing, not just for reference, but to help drive future policy changes for those currently denied that option.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>Deli-Style Marijuana Vs. Pre-packaged Marijuana<\/b><\/h2>\n<p><span style=\"font-weight: 400\">Most dispensaries dispense medical marijuana as prepackaged marijuana, cannabis that they portion, bag, and seal, leaving patients with little to no chance of viewing the quality inside. Some use opaque mylar bags to conceal the contents inside, while others use dark-colored jars. The reasons for doing so are varied; however, they are usually child safety, an outdated public health protocol, often due to COVID-19, or simply a lack of understanding of the needs of medical patients.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Patients in states like Colorado have it made\u2013not only do budtenders pull out huge jars of dank buds behind the counter for you to see up close, but they also allow patients to smell and squeeze them with tiny tongs as well.\u00a0<\/span><\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-39095\" src=\"https:\/\/www.veriheal.com\/blog\/wp-content\/uploads\/2025\/07\/pexels-jess-vide-9260000-300x200.jpg\" alt=\"Marijuana under light. In-store displays known as bud bars are areas where patients view available strains under glass, getting an idea of what they may look like once purchased.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">There\u2019s also usually a little window where patients can put their nose close to it like a dog\u2019s muzzle stuck in a rabbit hole in the hopes of getting a whiff of the aroma. While these devices may be practical to some people, looking at and trying to get a sniff of dried-out cannabis that\u2019s been sitting out under lights for weeks is often not a reliable preview of quality.<\/span><\/p>\n<h4><b>Seeing and Smelling Marijuana Gives Patients the Best Medicine for Their Money<\/b><\/h4>\n<p><span style=\"font-weight: 400\">Some brands of cannabis sold in medical dispensaries utilize clear jars to prepackage their flower. This is a great way to see the color, bud structure, and trichome coverage indicating potential quality; however, not being able to smell the medicine is still a disadvantage to the medical patient.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">If growers don\u2019t properly process cannabis after harvest with an optimal cure, cannabinoid content, and terpene profile, and it smells hay-like, the quality and potency of the medicine suffer. Some states do it both ways.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>What States Let Medical Patients See and Smell Cannabis Before Purchasing It?<\/b><\/h2>\n<p><span style=\"font-weight: 400\">The United States has 50 states and many other territories that all do their own thing, including laws, restrictions, and regulations for medical marijuana. Most of those states make the sale of cannabis flower legal to qualified patients, while others only allow for non-smokable forms of cannabis.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Veriheal reached out to medical dispensaries in every state with a medical marijuana program to confirm how it\u2019s done within their particular borders. In addition to speaking to dispensary managers and associates, Veriheal also contacted some state medical marijuana program headquarters to confirm whether patients in their states can see and smell the marijuana they wish to buy.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Keeping things consistent, we established four classes to group each state\u2019s medical marijuana program since we found so many differences, variations, and restrictions in each.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><b>Yes!<\/b><span style=\"font-weight: 400\"> There are no restrictions on seeing, smelling, and selecting the buds you want deli-style.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>Yes, but:<\/b><span style=\"font-weight: 400\"> You can see but not smell the marijuana, it\u2019s only viewable or sniffable in a bud bar, or the majority of dispensaries don\u2019t offer deli-style.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>No:<\/b><span style=\"font-weight: 400\"> There are strict state laws mandating that medical cannabis must be prepackaged before being sold to patients.<\/span><\/li>\n<li style=\"font-weight: 400\"><b>No, but:<\/b><span style=\"font-weight: 400\"> Some jars containing cannabis are clear to see, the dispensary has a sample they can let you view, depending on the brand, or it is on a county-by-county basis.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Let\u2019s explore the classification for all states with medical marijuana programs that allow for smokable cannabis flower.<\/span><\/p>\n<h3><b>Alabama<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No. Despite being one of the newer states to legalize medical marijuana in 2021 with the Compassion Act, <\/span><a href=\"https:\/\/amcc.alabama.gov\/patients\/#:~:text=The%20Alabama%20medical%20cannabis%20program%20is%20under%20development%20and%20is%20not%20registering%20patients%20or%20caregivers%20at%20this%20time.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Alabama is not registering patients or caregivers<\/span><\/a><span style=\"font-weight: 400\"> as of yet. The issue stems from legal delays, which could push the program\u2019s launch even past this year.\u00a0<\/span><\/p>\n<h3><b>Alaska<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Yes. Now that it seems like we\u2019ve got COVID under control, medical patients are being underserved by policies that are no longer needed and affect the affordability and quality of the medicinal flower they buy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cCOVID-19 caused dispensaries to stop doing deli-style, and they never went back.\u201d, said one Arizona budtender named Alex that we spoke to for this piece.\u00a0<\/span><\/p>\n<h3><b>Arkansas<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No, but. Arkansas only allows for <\/span><a href=\"https:\/\/codeofarrules.arkansas.gov\/Rules\/Rule?levelType=section&amp;titleID=20&amp;chapterID=132&amp;subChapterID=174&amp;partID=583&amp;subPartID=8451&amp;sectionID=55377\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">medical cannabis to be prepackaged<\/span><\/a><span style=\"font-weight: 400\">; however, some dispensaries have bud bars on display to see and smell the medical cannabis. California counties did away with deli-style dispensing in 2020, and it seems as though just about every county only allows for prepackaged cannabis since then.<\/span><\/p>\n<p><span style=\"font-weight: 400\">We reached out to a representative at the <\/span><a href=\"https:\/\/codeofarrules.arkansas.gov\/Rules\/Rule?levelType=section&amp;titleID=20&amp;chapterID=132&amp;subChapterID=174&amp;partID=583&amp;subPartID=8451&amp;sectionID=55377\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">California Department of Cannabis Control <\/span><\/a><span style=\"font-weight: 400\">to confirm, and even he wasn\u2019t 100% sure if there were any counties still doing deli-style. \u201cIt isn\u2019t really a thing anymore.\u201d, he said during a brief chat.<\/span><\/p>\n<h3><b>Colorado<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Yes! The mighty Centennial State\u2013home of the majestic Rocky Mountains, the 1st state to legalize cannabis, and one of the last places where <\/span><a href=\"https:\/\/www.veriheal.com\/colorado\/\"><span style=\"font-weight: 400\">medical patients can see, sniff, and choose <\/span><\/a><span style=\"font-weight: 400\">the buds they want.\u00a0<\/span><\/p>\n<h3><b>Connecticut<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No, but. Medical marijuana patients in Connecticut can only purchase cannabis flower in prepackaged containers according to state law. Nick, a budtender at Bluepoint Wellness, confirmed that some dispensaries have display jars for viewing.<\/span><\/p>\n<h3><b>Delaware<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No. The Delaware medical marijuana dispensary manager we spoke to mentioned that the program has gone completely prepackaged since the COVID era as well. He was hopeful that once <\/span><a href=\"https:\/\/news.delaware.gov\/2025\/07\/01\/delaware-to-launch-adult-use-marijuana-on-august-1\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Delaware\u2019s Adult Use program<\/span><\/a><span style=\"font-weight: 400\"> goes into effect, the option for deli-style dispensing will <\/span><span style=\"font-weight: 400\">resume.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to comments by Delaware\u2019s marijuana commissioner, there is an opportunity for dispensaries to seek <\/span><span style=\"font-weight: 400\">a <a href=\"https:\/\/whyy.org\/articles\/delaware-marijuana-weed-dispensaries-deli-style\/#:~:text=%E2%80%9CAs%20long%20as%20they%20satisfy%20those%20areas%20of%20concern%2C%20then%20we%20could%20issue%20the%20variance%20and%20they%20would%20be%20able%20to%20offer%20marijuana%20in%20that%20form%20as%20well%20as%20the%20prepackaged%20form%2C%E2%80%99%E2%80%99%20Coupe%20said.\" target=\"_blank\" rel=\"noopener\">\u201cvariance\u201d to allow for deli-style dispensing<\/a><\/span><span style=\"font-weight: 400\">; however, this variance doesn\u2019t seem to have gone any further since his comments were made last year.\u00a0\u00a0<\/span><\/p>\n<h3><b>Florida<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Yes, but. The Sunshine State attempted to go recreational in 2024, but the initiative spearheaded by one of the state\u2019s largest medical marijuana dispensaries failed to meet the threshold of votes needed. Medical marijuana patients, on the other hand, can frequent any of the <\/span><a href=\"https:\/\/floridastatecannabis.org\/dispensaries#:~:text=As%20of%202025,in%20the%20state.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">approximately 721 (and counting)<\/span><\/a><span style=\"font-weight: 400\"> medical dispensaries found in Florida.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Most dispensaries only offer prepackaged flower to patients, but some Medical Marijuana Treatment Centers (MMTCs) like GrowHealthy confirmed that they open the prepackaged cannabis you wish to buy right there at the counter for you to see and smell.\u00a0<\/span><\/p>\n<h3><b>Hawaii<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No. The 50th state was the 1st state to legalize medical marijuana by state legislature passage. Despite several updates over the years, it appears that state law mandates that cannabis flower be prepackaged before sale to qualified patients.\u00a0<\/span><\/p>\n<h3><b>Illinois<\/b><\/h3>\n<p><span style=\"font-weight: 400\">The <\/span><a href=\"https:\/\/idfpr.illinois.gov\/content\/dam\/soi\/en\/web\/idfpr\/forms\/auc\/faqs-for-185-conditional-licenses-7-1-2022.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Illinois Department of Financial and Professional Regulation<\/span><\/a><span style=\"font-weight: 400\"> makes it pretty clear that deli-style and display is outlawed, according to their FAQs section: \u201cDispensaries are not permitted to display unpackaged products through something like a window case under the current Act or Rules.\u201d<\/span><\/p>\n<h3><b>Kentucky<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No. Kentucky is another state still working on <\/span><a href=\"https:\/\/governor.ky.gov\/attachments\/20241125_KyMedCan_Dispe\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">rolling out its medical marijuana program<\/span><\/a><span style=\"font-weight: 400\">, so the rules on dispensing cannabis to patients aren\u2019t quite clear right now. It currently looks like no Kentucky county will have more than one medical dispensary allowed, a big setback for patients before the program has even started.\u00a0<\/span><\/p>\n<h3><b>Louisiana<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No, but. According to some dispensary managers we spoke to in Louisiana, seeing and smelling the cannabis before you purchase it is not very common, but some dispensaries do practice it with sample jars.\u00a0<\/span><\/p>\n<h3><b>Maine<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Yes! Maine is another mountainous wonder that has no restrictions concerning the dispensing of medical marijuana. Most dispensaries in Maine provide their customers with a deli-style purchasing experience.\u00a0<\/span><\/p>\n<h3><b>Maryland<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Yes, but. Medical dispensaries can offer deli-style sales to patients only if they comply with <\/span><a href=\"https:\/\/cannabis.maryland.gov\/documents\/2022_pdf_files\/bulletins\/mmcc%20bulletin%20-%202022-002.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Maryland\u2019s Deli-Style Approval Procedure<\/span><\/a><span style=\"font-weight: 400\">, created in 2022. The requirements include an inspection by the Maryland Medical Cannabis Commission and subsequent written approval by the same commission. If not approved, the dispensary can only offer pre-packaged flower to patients.<\/span><\/p>\n<h3><b>Massachusetts<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No, but. Massachusetts was the first East Coast state to legalize cannabis for adult use. Their medical marijuana program still services thousands of patients; however, those patients can only buy prepackaged flower. Some budtenders we spoke to told us that there are displays of cannabis that sit out for months at a time, not a very good gauge of the quality that patients can expect.\u00a0<\/span><\/p>\n<h3><b>Michigan<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Yes! Michigan is one of the least restrictive states for growers of cannabis. Really good marijuana is abundant everywhere in Michigan, especially for medical patients who can often choose from both deli-style and prepackaged flower options.<\/span><\/p>\n<h3><b>Minnesota<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Yes, but. Qualified Minnesotans can view and sniff their marijuana from display sample jars with screens for aromas.<\/span><\/p>\n<h3><b>Mississippi<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No. Deli-style sales are not permitted in Mississippi. We spoke to the manager at River Remedy in Byram, Mississippi, who told us that they and other medical dispensaries in the state enjoy selling prepackaged flower because they\u2019re often understaffed and because it keeps things simple.\u00a0<\/span><\/p>\n<h3><b>Missouri<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Yes! Deli-style dispensing is allowable by law in Missouri. Its availability depends on the brand and the dispensary.\u00a0\u00a0<\/span><\/p>\n<h3><b>Montana<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Yes! Montana allows deli-style sales on a store-by-store basis. Budtenders in several different dispensaries in the Big Sky State mentioned that some dispensaries offer deli-style, others offer only prepackaged cannabis, and some allow prepackaged cannabis to be opened to see and sniff for quality. Dispensaries offering deli-style must utilize a specific standard operating procedure mandated by the Montana Department of Revenue.\u00a0<\/span><\/p>\n<h3><b>Nebraska<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No. The Nebraska Medical Cannabis Commission is still ironing out the regulations for its medical marijuana program that was approved by voters in dual medical cannabis initiatives\u2013<\/span><a href=\"https:\/\/ballotpedia.org\/Nebraska_Initiative_437,_Medical_Marijuana_Legalization_Initiative_(2024)\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Initiative 437<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/ballotpedia.org\/Nebraska_Initiative_438,_Medical_Marijuana_Regulation_Initiative_(2024)\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Initiative 438<\/span><\/a><span style=\"font-weight: 400\">.\u00a0\u00a0<\/span><\/p>\n<h3><b>Nevada<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No, but. We reached out to a contact for the<\/span><a href=\"https:\/\/newhampshirecannabis.org\/mmj-program#:~:text=Established%20in%202013,medical%20marijuana%20program.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\"> Therapeutic Cannabis Program<\/span><\/a><span style=\"font-weight: 400\"> in New Hampshire. This official confirmed that \u201call cannabis must be prepackaged at the point of production before being made to sell at medical dispensaries.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">He also confirmed that many medical dispensaries in the state are returning to using smeller jars to see and smell the products since they went away during COVID-19.<\/span><\/p>\n<h3><b>New Jersey<\/b><\/h3>\n<p><span style=\"font-weight: 400\">No, but. The Garden State mandates prepackaging of cannabis, an unfortunate factor in a state that pulls in over <\/span><a href=\"https:\/\/www.nj.gov\/cannabis\/news-events\/20241223.shtml#:~:text=New%20Jersey%E2%80%99s%20cannabis%20market%20surpassed%20%241%20billion%20in%20combined%20medicinal%20and%20recreational%20cannabis%20sales%20in%202024%2C\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">$1 billion a year in medical and recreational sales<\/span><\/a><span style=\"font-weight: 400\">.
