However, Nevada law requires employers to <\/span><a href=\"https:\/\/www.leg.state.nv.us\/App\/InterimCommittee\/REL\/Document\/2371\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">reasonably accommodate the medical needs<\/span><\/a><span style=\"font-weight: 400;\"> of employees who use medical cannabis, so long as it doesn\u2019t cause hardship on the employer or prevent the employee from carrying out their duties.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The specific rules of medical cannabis in the workplace vary greatly from state to state. For example, <\/span><a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2017A\/8A\/BillText\/er\/PDF\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Florida law<\/span><\/a><span style=\"font-weight: 400;\"> states:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0\u201cThis section does not limit the ability of an employer to establish, continue, or enforce a drug-free workplace program or policy. This section does not require an employer to accommodate the medical use of marijuana in any workplace or any employee working while under the influence of marijuana. Florida Senator Tina Scott Polsky <\/span><a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2026\/136\/?Tab=BillHistory\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">recently filed a bill<\/span><\/a><span style=\"font-weight: 400;\"> to provide protections for public employees who use medical cannabis.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>Does the ADA Protect Medical Cannabis Users?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Despite widespread acceptance of medical cannabis, it\u2019s still illegal under federal law. The plaintiff\u2019s employer fired him after he tested positive for THC in a random drug test.
